1. General description of the InfoP website
1.1. InfoP lets the user register to receive by email or text message (depending on the options available and/or selected) information concerning municipal issues based on categories he or she selects beforehand.
1.3. The InfoP website is operated and administered by the Town of Pincourt, which uses it exclusively to transmit public interest messages it produces.
1.4. At no time will the Town of Pincourt use this service to transmit to users information that is commercial, promotional, religious or political in nature, or to carry out solicitation or disseminate propaganda.
2. Intellectual property
2.1. The intellectual property held by the InfoP website, including all of its content (logos, text, information, images, software, etc.) belongs exclusively to the Town of Pincourt and its supplier, Locomotive Inc. The user is thus not authorized to reproduce, modify, transmit, publish or create works derived from the elements cited above.
3. Responsibilities of the user
3.1. The user undertakes to keep his or her information up to date.
3.2. The user understands and accepts that the content of the messages transmitted by the InfoP service does not replace the by-law in force and that in the event of an inconsistency with municipal by-laws, the latter shall take precedence.
3.3. The user understands and accepts that the Town of Pincourt cannot guarantee the accuracy of the information transmitted by the InfoP service and, consequently, that at no time will the service assume responsibility for any inconveniences or damages caused by erroneous information, an inability to reach the user (contact details not updated, electronic problems, power failures, breakage, etc.) or the non-use of the InfoP website to transmit specific information.
3.4. The user undertakes to keep his or her password confidential and is responsible for all actions carried out on his or her account.
3.5. The user undertakes not to use InfoP for illicit purposes, including to:
- Knowingly transmit a virus or any other destructive element;
- Execute a mass mailing of an unsolicited electronic email (SPAM);
- Attempt to breach the security of systems implemented on the website or render it unusable;
- Access the accounts of other clients of the InfoP website or collect personal information on other clients;
- Transmit messages containing content that is illegal, defamatory, offensive, obscene, harassing or hateful.
3.6. Any user making illicit use of the InfoP website shall be subject to sanctions, legal action and other proceedings provided for under law.
3.7. The Town of Pincourt and Locomotive Inc. reserve the right to terminate a user’s subscription with InfoP at any time, to restrict it if the user makes inappropriate use of the website or appears to do so, or to terminate the subscription for any other reasonable cause.
4. Responsibilities of the Town of Pincourt and Locomotive Inc.
4.2. The Town of Pincourt undertakes not to transmit any message that is commercial, promotional, religious or political in nature, or transmit any message for purposes of propaganda or solicitation.
4.3. The Town of Pincourt undertakes to use reasonable means to transmit accurate information through the InfoP website. However, it cannot guarantee the accuracy of the information transmitted and in this regard, the user acknowledges that he or she is using the InfoP website “at his or her own risk.” It is incumbent on the user, therefore, to assess the usefulness and reliability of the content of messages transmitted by the Town of Pincourt.
4.4. The Town of Pincourt reserves the right to change or discontinue, in whole or in part, on a temporary or permanent basis, any service offered on the InfoP website, at any time and at its sole discretion.
5.1. The user agrees to indemnify and hold harmless the Town of Pincourt, including its directors and employees, as well as Locomotive Inc., including its employees and affiliated companies, against any legal action, claim or other proceeding stemming from the use of the InfoP website.
6.1. The user undertakes to use the InfoP website at his or her own risk, while the services offered by this website are provided “as is” and “according to their availability.” Consequently, the Town of Pincourt and Locomotive Inc. provide no guarantee related to the content and services offered by InfoP.
6.2. The Town of Pincourt, including its employees, and Locomotive Inc., including its directors and employees and affiliated companies, may not be held liable for any damages or other linked to the use of the InfoP website, or for any impossibility in using it.
1. Collection of personal information
1.1. In order to use the InfoP website, the user, on a voluntary basis, is asked to provide the following information:
- Name (optional)
- Civic address (mandatory)
- Email address (mandatory to receive the service)
- Postal code (mandatory)
- Contact number and name of cell phone supplier (mandatory if the user chooses this communications option).
1.2. This personal information is collected using an online form. It is incumbent upon the user to inform the Town of Pincourt of any changes in the above-cited information transmitted, notably for purposes of the security of exchanges and the reception of the said alerts.
1.3. Otherwise, the service supplier, Locomotive Inc., also uses log files and cookies to obtain information on the user with the objective of improving the user experience and offering the user a better service. These files serve to collect the following information:
- IP address
- Operating system
- Pages visited and searches
- Time and day of connection
1.4. The user may deactivate the cookies by using the browser function provided for that purpose.
2. Confidentiality and protection of personal information
2.1. The Town of Pincourt and its supplier, Locomotive Inc., will not disclose any personal information to a third party concerning the users of the website, except if required within the framework of a legal requirement, a legal procedure or a change of supplier for the management of the InfoP website. No personal information will be disclosed, therefore, or sold for commercial purposes.
2.2. The Town of Pincourt undertakes to allow users to consult, change, or even delete information concerning them, through their personal accounts or in response to a request filed with the Town of Pincourt’s customer service department.
2.3. Personal information is kept in a secure environment. In order to ensure the security of personal information, the service supplier, Locomotive Inc., has recourse to the following measures:
- Access management – authorized person
- Network monitoring software
- Computer backup
- Identifier / password
2.4. The service supplier, Locomotive Inc., also undertakes to maintain a high level of privacy by integrating reasonable technological measures aimed at ensuring the privacy of information.
2.5. However, given that the Internet, by its very nature, is a public network, the Town of Pincourt and its supplier, Locomotive Inc., cannot guarantee or assume responsibility for any violation of privacy, hacking, virus, loss or alteration of data transmitted by Internet or stored on systems held by Locomotive Inc.
2.6. At the request of the user, or in the event that his or her subscription is cancelled, his or her account shall be closed and the personal information contained therein shall be destroyed.
2.7. However, the Town of Pincourt and its supplier, Locomotive Inc., reserve the right, for an undetermined period and within the limits applicable under Quebec law, to hold certain personal information in order to comply with the law, prevent fraud, resolve a claim or other specific problems relating thereto, cooperate with an inquiry, ensure compliance with the website’s User Agreement, and for the purposes of any other act permitted under law. Upon the expiration of this period, the data contained in the files will be destroyed or deleted from our systems.
